Branding and Customized Orders

By placing an order for branded or customized products, the customer acknowledges and agrees to the following terms and conditions.

1. Deposits and Payment

1.1. A deposit of 50% is required before any branding, customization, or production work commences, unless otherwise agreed in writing.

1.2. Deposits secure the order, production allocation, materials, and associated preparation costs.

1.3. No branding or production will commence until the required deposit has been received and the final artwork has been approved.

1.4. The outstanding balance must be paid in full before the completed goods are dispatched or collected.

2. Branding and Production Lead Times

2.1. All quoted branding and production lead times are estimates and may vary depending on order quantities, stock availability, branding methods, and production capacity.

2.2. Lead times commence only once the following requirements have been met:

  • The required deposit has cleared.
  • Final artwork has been submitted and approved.
  • All branding specifications have been confirmed.
  • The required products and materials are available.

2.3. Any delays in submitting artwork, approving designs, confirming specifications, or making payments may result in revised production and delivery dates.

2.4. Customers are responsible for informing us of any specific deadlines or event dates before confirming their orders.

2.5. We cannot guarantee completion by a specific date unless that deadline has been expressly confirmed in writing by both parties.

3. Missed Deadlines and Customer Responsibility

3.1. Customers are responsible for ensuring that sufficient time is allowed for branding, production, and delivery.

3.2. If a customer proceeds with an order despite being advised that the requested deadline cannot be guaranteed, the customer accepts the associated risk of late completion.

3.3. Where production delays result from late artwork approvals, incomplete information, changes to specifications, or outstanding payments, the customer will not be entitled to a refund or cancellation without applicable charges.

3.4. Failure to meet a customer's preferred deadline does not automatically entitle the customer to cancel the order or receive a refund, particularly where the deadline was not expressly guaranteed in writing.

3.5. Where a guaranteed deadline is missed due to circumstances within our reasonable control, the matter will be assessed in accordance with applicable consumer protection legislation.

4. Cancellation and Forfeiture of Deposits

4.1. Once an order has been confirmed and a deposit paid, cancellation may result in the partial or full forfeiture of the deposit, subject to applicable law.

4.2. Deposits may be retained to cover reasonable costs already incurred, including:

  • Artwork preparation and design.
  • Branding setup and production preparation.
  • Materials and products specifically ordered.
  • Labour and production costs.
  • Administrative and other reasonable cancellation-related expenses.

4.3. If a customer cancels an order because their event date or required deadline has passed, the deposit may be forfeited where the delay was caused by the customer or where no guaranteed completion date was agreed.

4.4. Once branding or customization has commenced, cancellation may result in additional charges for work already completed.

4.5. Any cancellation fees or deposit deductions will be reasonable and proportionate to the circumstances, in accordance with the Consumer Protection Act 68 of 2008, where applicable.

5. Artwork Approval and Branding Accuracy

5.1. Customers must carefully review and approve all artwork, spelling, colors, logos, positioning, and branding specifications before production.

5.2. Once artwork has been approved, the customer accepts responsibility for errors contained in the approved design.

5.3. Changes requested after approval may incur additional costs and extend production lead times.

5.4. Minor variations in color, positioning, and finished appearance may occur due to differences in materials and branding processes.

6. Delays Beyond Our Control

6.1. We will make reasonable efforts to complete all orders within the estimated production period.

6.2. Delays may occur due to supplier shortages, equipment failures, transport disruptions, power interruptions, or other circumstances beyond our reasonable control.

6.3. Customers will be informed of material delays as soon as reasonably practicable.

6.4. Nothing in these terms excludes any rights or remedies available to customers under applicable South African consumer protection legislation.

7. Acceptance of Terms

7.1. By paying a deposit, approving artwork, or confirming a branding order, the customer acknowledges acceptance of these Terms and Conditions, provided they were made available before the order was concluded.

7.2. Customers are encouraged to clarify all deadlines, production requirements, and cancellation conditions before making payment.

7.3. These terms are subject to the Consumer Protection Act 68 of 2008 and other applicable South African laws.
